2. PURPOSE
These terms govern the purchase of handcrafted design pieces, made to order and sold at www.caitanadas.com. Use of the site implies acceptance of the Legal Notice, Privacy Policy and Cookie Policy.

3. USERS

• Users must be over 18 years of age and have the legal capacity to enter into contracts.

• Users guarantee that the information they provide is true and accurate.

• Users agree not to use the site for unlawful purposes.

4. PURCHASE PROCESS

• The Customer selects the products, adds them to the cart, confirms the order and completes payment.

• The Customer will receive by email the order confirmation with the purchase details, the invoice and the shipping notification with a tracking number.

• Each order starts the production of new pieces. By confirming, the Customer accepts that the pieces will be made specifically for their order.

• Professional orders and quotes: for orders of more than 10 units, bespoke pieces or payment by bank transfer, the Customer may request a personalised quote at info@caitanadas.com.

5. AVAILABILITY

• All orders are subject to the availability of materials.

• If any material is unavailable, the Customer will be informed and the full amount paid will be refunded.

6. PRICES AND PAYMENT

• Prices are shown in euros (€) and include Spanish VAT where applicable.

• Sales to businesses established in another European Union Member State with a valid intra-community VAT number are invoiced VAT-exempt. To apply, the Customer must provide their VAT number when placing the order.

• For shipments outside the European Union (such as the United Kingdom or Switzerland), import duties and taxes are not included and are payable by the Customer.

• Shipping costs are calculated in the cart according to the destination and the weight of the order, and are free above certain order values, as set out in our Shipping Policy.

• Payment methods: card, PayPal, Apple Pay and Google Pay, through a secure connection. For orders with a personalised quote, bank transfer is also accepted.

• Payment is taken when the order is confirmed. If the payment is not authorised, the order is cancelled and the Customer is informed.

7. DELIVERY

• Delivery areas:

  • Spain: mainland and Balearic Islands.

  • Europe: Andorra, Austria, Belgium, Czech Republic, Denmark, Finland, France, Germany, Greece, Italy (excluding islands), Luxembourg, Monaco, Montenegro, Netherlands, Norway, Poland, Portugal, Slovakia, Slovenia and Sweden.

  • United Kingdom, Ireland and Switzerland.

  • For the Canary Islands, the Italian islands and other destinations, please contact us at info@caitanadas.com.

• Delivery time: 10 to 30 days from order confirmation, depending on demand and destination.

• Orders are shipped with DHL, in custom-made wooden crates that protect the pieces.

• If the carrier cannot deliver because nobody is available, they will leave a notice and a new delivery can be arranged.

• Ownership of the products passes to the Customer when CAITANADAS receives full payment, or on delivery if this is later. Risk passes to the Customer on delivery.

8. ORDER ERRORS

• The Customer can correct errors during the purchase process, before confirming and paying.

• Once the order has been placed, corrections can be requested by email at info@caitanadas.com, provided production has not yet started.

9. RETURNS, RIGHT OF WITHDRAWAL AND WARRANTY
All CAITANADAS pieces are handcrafted and made to order for each purchase. For this reason, returns for change of mind are not accepted. The right of withdrawal does not apply to goods made to the customer’s specifications or clearly personalised, in accordance with Article 103(c) of Spanish Royal Legislative Decree 1/2007 (TRLGDCU).

The right of withdrawal applies to consumers only. Purchases made by businesses and professionals (hotels, restaurants, catering and events companies) are not subject to this right.

Due to their handcrafted nature, pieces may show slight variations in shape and in the natural veining of the stone. These variations are not considered defects or grounds for return.

When can you request a replacement or refund?

• Damage in transit: please check the crate in front of the courier and report any damage within 48 hours of delivery.

• Defective product, or product that does not match your order: please report it within 14 calendar days of delivery.

In both cases, email info@caitanadas.com with:

• Photos of the product and the packaging.

• A brief explanation of the problem.

• Your order number.

If the claim is accepted, we will offer, at the Customer’s choice, a replacement at no extra cost or a full refund of the product and shipping costs.

Returns of used or tampered products, or products not in their original packaging, will not be accepted.

All pieces carry a 2-year warranty against manufacturing defects, as detailed on our Warranty and Care page.

10. LIMITATION OF LIABILITY

• CAITANADAS shall not be liable for indirect losses such as loss of profit or business interruption.

• Product images are for guidance only. Pieces may differ slightly due to their handcrafted nature and the natural veining of the stone.

• No liability is accepted for courier delays, technical failures of the website or force majeure, such as social unrest, natural disasters or changes in legislation.

• No liability is accepted for incorrect use or normal wear and tear of the products.

11. COMMUNICATIONS

• Communications will preferably be made by email or through notifications on the website.

• The User agrees that these channels meet the legal requirement for written communication.

12. WAIVER AND SEVERABILITY

• Failure by CAITANADAS to enforce strict compliance with any of these terms does not constitute a waiver of its rights.

• If any clause is declared invalid, the remaining clauses will remain in force.

13. ENTIRE AGREEMENT
These Terms, together with the Legal Notice, Privacy Policy, Cookie Policy and Shipping Policy, constitute the entire agreement between the parties.

14. DATA PROTECTION
Customer data will be processed in accordance with the CAITANADAS Privacy Policy.

15. GOVERNING LAW AND JURISDICTION

• These terms are governed by Spanish law.

• Any dispute shall be submitted to the competent Spanish courts, without prejudice to the rights granted to consumers by law.
